Department Introduction

 

The labour department of the state is implementing 21 central laws applicable to the state and three state laws enacted by the state legislature. The department has been re-energized to accelerate its activities in all spheres.

            Identification and registration of the target groups (both employers as well as the employees) under various labour laws has been fast tracked. The ambit of coverage of non- factory establishments under employees state insurance schemes has been increased by reducing the minimum threshold limits of employee from 20 to 10 through SRO 80 dated 05/03/2012.this has satisfied a very long pending demand of the working class of the state and is going to benefit a large number of employees who were not covered so far in shops, hotels, restaurants road motor transport establishments, cinemas, newspaper establishments, educational institute and medical institutes. This is turn will attract more youth to go for employment in the private sector. It is also expected to boost the industrial growth in the long run. Coverage of laborers in unorganized sector has also increased for benefits under the building and other constructions workers (regulation of conditions of services) Act. The board started functioning effectively from February, 2011 when the first meeting of its board directors was held. The number of establishment registered has gone up from 169 at the beginning of the current fiscal to 346 as of now. The number of workers registered with the board was nil up to March, 2011 and it has gone up to 53,279 as on 12/3/2012. The cess collection was Rs. 37.91 crore as on March, 2011 and now gone up to Rs. 10107.79 Lacs including the interest as on 29/02/2012. An amount of Rs. 2, 55, 75,100.00 has been disbursed among 3600 beneficiaries/workers under different welfare schemes framed for the welfare of the building and other construction workers by the respective ALS’s as on 12/03/2012. In District Udhampur Rs.6.11 has been disbursed among 102 beneficiaries as on 31/03/2012.

            Enforcement of labour laws aimed at creation of healthy and safe environment at work sites both in organized and unorganized sector for environment friendly development and industrial growth has been up scaled. The disposal of cases has been up scaled under various laws like the shops and establishments Act,1966,payment of wages Act,1936,Payment  Gratuity Act,1972,Child Labour Act, 1986,MinimumWagesAct,1948 and payment of bonus Act,1965,Contract labour Act, 1970.

             The enforcement measures have also resulted in realization of revenue for the state. Total revenue realization under various Acts was Rs.138.84 Lacs during last financial years. during current financial years it is Rs.135.64 Lacs up to January, 2012 and we expect to cross all time high of Rs. 150.00 Lacs.The total number of inspection conducted under various Acts was 21,206 during last financial year, it is18,910during the current financial year up to January ,2012. The number of prosecutions launched last year was 1377 and this year so far it is 1145 year up to January, 2012. The fine imposed last year was Rs. 8.61 Lacs and this year it is Rs. 3.52 Lacs up to January, 2012 which indicated decrease in violations. In district udhampur total revenue realization under various Acts was Rs. 6, 34,758 during last financial year. During current financial years it is Rs.7, 18,626 up to 31 March 2012.and we expect to cross all time high of Rs. 10.00 Lacs. The total number of inspections conducted under various Acts was 1048 during last financial year. It is 1619 during the current financial year up to march 2012.the number of prosecutions launched last year was 79 and this year 145 up to march 2012. The fine imposed last year was Rs. 10,250 and this year it was Rs. 72,315 up to 31 March 2012.

             Minimum wages are revised at least once in five years. Last revision took place in the shape of SRO the minimum wages for non skilled labourer was fixed Rs.110/-per day. The fast inflation rate and the rates prevalent in other states necessitated revision of the minimum wages.SRO 61 dated 9/02/2012has been issued indicating proposed revised rates and published for inviting objections/suggestions. Final view will be taken after giving due consideration to the suggestions/objections as may be received. For unskilled labourer the minimum wages of Rs.150 per day has been purposed. The government is also considered introduction of variable Dearness Allowances (VDA) in the state by virtue of which periodical VDA will be paid to the employees once in six months or more once in a year commensurate to the increase in price index. Efforts will be made to ensure payment of wages through non cash methods through banks and post offices etc.

             Social security measures are of prime concern to us. Employees provident fund scheme, employee deposit related insurance scheme, maternity benefits scheme and several other social security schemes presently in vogue in the state are being made more effective. we have initiated tripartite discussions on increasing threshold limit of employees for provident fund purposes from 5 to 10, the central provident fund has limit of 20 which is likely to be reduced to 15 or 10 .the employees demand for increase in rate of the employers contribution and the rate of interest on the provident fund is also under tripartite discussion. A rationale and amicable output of the discussions is expected shortly.

             Eradication of child labour shall be forefront activity in the years 2012-13. We are supporting move of the central government to impose absolute ban on child labour in both hazardous and non hazardous activities up to the age of 14 while at the same time ensuring that these children go the schools.

In district udhampur “national child labour project is being implemented in which 11 schools under the age of 14 years are being provided free education as well as a scholarship of Rs. 150 /-child/month. Free mid day meals are also being provided by the education department.
